1. Who we are
This store is operated as XTREMOTIVATION, a brand of KREATIVE MONSTER GLOBAL, a SASU registered with the R.C.S. Nanterre under SIREN 109 679 761, whose registered office is at 99 avenue Achille Peretti, 92200 Neuilly-sur-Seine, France (the "Company", "we"). By accessing this site or placing an order, you accept these terms.
2. Purpose
These terms and conditions govern the use of the site and the distance sale of our items to consumers and buyers for delivery in the countries open to orders. These are currently France, Germany (in the European Union), the United Kingdom, the United States and Canada; the up-to-date list is on our Shipping page. They apply without restriction or reservation to any order.
3. Use of the store
You may browse the site, create an account and place orders for personal, non-commercial use. You agree not to misuse the site, not to attempt to disrupt its operation, not to scrape it at scale, and not to use it in breach of the law. You are responsible for keeping your credentials confidential and for any activity carried out from your account.
4. Products and pre-orders
Items in the current drop are sold on pre-order. Pre-orders are governed by our Pre-order terms, which form an integral part of this contract. Each order has a contractual latest delivery date, shown at checkout before payment and recalled in the order confirmation; the remedies if it is exceeded are set out in the Pre-order terms. Visuals, descriptions and colours are presented as faithfully as possible, but slight variations may exist between a screen and a physical garment.
5. Prices and payment
Prices are shown in euros. The Company is VAT-exempt under article 293 B of the French General Tax Code: no VAT is added to or included in our prices. Payment is processed by Stripe (and PayPal where offered). We do not store your full card details. Payment is charged at order time, as stated in the Pre-order terms. In the event of an obvious pricing error, we reserve the right to cancel the order concerned and refund any amount already charged.

6. Cancellation, right of withdrawal and returns
As a consumer, you can cancel your order at any time until it ships, for a full refund, and you have 14 days from delivery to withdraw without giving a reason (articles L.221-18 and following of the French Consumer Code). The direct cost of returning the goods after a withdrawal is borne by you. The procedure, the time limits and the model withdrawal form are detailed in the Pre-order terms and on the Returns and refunds page.
7. Legal guarantees

The consumer has a period of two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity, not the date on which it appeared.
Where the contract of sale of the goods provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only has to establish the existence of the lack of conformity affecting the digital content or digital service, not the date on which it appeared.
The legal guarantee of conformity obliges the professional, where applicable, to supply all updates necessary to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer asks for the goods to be repaired but the seller imposes a replacement, the legal guarantee of conformity is renewed for a period of two years from the date the goods are replaced.
The consumer may obtain a reduction of the purchase price while keeping the goods, or end the contract and be refunded in full against return of the goods, if:
1. The professional refuses to repair or replace the goods;
2. The repair or replacement takes place after a period of thirty days;
3. The repair or replacement causes major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4. The lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.
The consumer is also entitled to a price reduction or to terminate the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer then does not have to ask for repair or replacement first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee until the repaired goods are delivered.
The rights set out above result from articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs the application of the legal guarantee of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.
8. Intellectual property
All content on the site (the XTREMOTIVATION name, logos, garment designs, illustrations, graphics, text and photographs) belongs to the Company or its licensors and is protected by intellectual property law. Purchasing a product only gives you ownership of the physical item. It transfers no right to reproduce, resell at scale, or commercially exploit our creations or our brand.
9. Accounts
You must provide accurate information when you register. We may suspend or close any account that breaches these terms, is used fraudulently, or is used to harass others.
10. Liability
Nothing in these terms excludes or limits our liability towards a consumer, nor the legal guarantees set out in section 7.
If you buy as a professional (not as a consumer), and to the extent permitted by law, the Company is not liable for indirect damages, and its liability is limited to the amount paid for the order concerned.

Your data is processed as described in our Privacy Policy and our Cookie Policy.
12. Changes to these terms
We may update these terms. The version that applies to an order is the one in force at the time the order is placed. A legal snapshot is recorded with every order.
13. Governing law and disputes
These terms are governed by French law. In the event of a dispute, you may use consumer mediation free of charge (article L.612-1 of the French Consumer Code); the details of the designated consumer mediator will be published in our Legal Notice. Failing an amicable resolution, the dispute falls under the competent courts, without prejudice to the mandatory consumer protection rules of your country of habitual residence.
