1. Who we are
This store is operated as XTREMOTIVATION, the brand run by Kreative Monster (Steeve Aukingso) (the "Company", "we"). Our identity and contact details are set out in our Legal Notice. By accessing this site or placing an order, you accept these terms.
2. Purpose
These terms and conditions govern the use of the site and the distance sale of our items to consumers and buyers, in France and in the open zones of the European Union. They apply without restriction or reservation to any order.
3. Use of the store
You may browse the site, create an account and place orders for personal, non-commercial use. You agree not to misuse the site, not to attempt to disrupt its operation, not to scrape it at scale, and not to use it in breach of the law. You are responsible for keeping your credentials confidential and for any activity carried out from your account.
4. Products and pre-orders
Items in the current drop are sold on pre-order. Pre-orders are governed by our Pre-order terms, which form an integral part of this contract. Visuals, descriptions and colours are presented as faithfully as possible, but slight variations may exist between a screen and a physical garment.
5. Prices and payment
Prices are shown in euros, inclusive of tax where applicable. Payment is processed by Stripe (and PayPal where offered). We do not store your full card details. Payment is charged at order time, as stated in the Pre-order terms. In the event of an obvious pricing error, we reserve the right to cancel the order concerned and refund any amount already charged.
6. Right of withdrawal and returns
As a consumer, you have a right of withdrawal under the conditions provided by consumer law. The terms, the time limit, the statutory exceptions and the procedure to follow are detailed on the Returns and refunds page.
7. Intellectual property
All content on the site (the XTREMOTIVATION name, logos, garment designs, illustrations, graphics, text and photographs) belongs to the Company or its licensors and is protected by intellectual property law. Purchasing a product only gives you ownership of the physical item. It transfers no right to reproduce, resell at scale, or commercially exploit our creations or our brand.
8. Accounts
You must provide accurate information when you register. We may suspend or close any account that breaches these terms, is used fraudulently, or is used to harass others.
9. Liability
To the extent permitted by law, the Company is not liable for indirect damages arising from your use of the site or of a product, beyond the amount you paid for the order concerned. Nothing in these terms limits the rights you have under the law as a consumer, including your statutory rights set out on our Returns and refunds page.
10. Privacy and cookies
Your data is processed as described in our Privacy Policy and our Cookie Policy.
11. Changes to these terms
We may update these terms. The version that applies to an order is the one in force at the time the order is placed. A legal snapshot is recorded with every order.
12. Governing law and disputes
These terms are governed by French law. In the event of a dispute, you may use consumer mediation free of charge; the designated consumer mediator is indicated in our Legal Notice. Failing an amicable resolution, the dispute falls under the competent courts, without prejudice to the mandatory consumer protection rules of your country of residence in the European Union.
